Dear Members of the Alcoholic Beverage Regulation Administration:

Advisory Neighborhood Commission 3D met on July 7, 2004, with a quorum (4) present at all times, to consider the application of Listrani's Italian Gourmet Restaurant and voted 5-2-0 to support the renewal of its license. The commission also supported a new Voluntary Agreement with the restaurant. The meeting was attended by a large number of immediate neighbors who presented the commission with a petition to deny the license but did not cite specific reasons the license should not be renewed. However, the major complaint from neighbors who attended the meeting was employee parking in blocks that the ANC had placed off limits to parking in a Voluntary Agreement drawn up be a previous ANC Commission.

The Single Member District Commissioner and Chair of ANC 3D has been a member of the Mayor's Task Force on Parking for the past two years. She stated the ANC cannot tell anyone where they can and cannot park if the parking is in public space, citing that public parking is governed by DC Parking regulations. She introduced a new Voluntary Agreement that the Commission approved and will be presented to Fuad Farah, owner of Listrani's for signature the week of July 11, 2004. A copy of the agreement will be forwarded to ABRA when signed. In addition to the Voluntary Agreement, the chair will seek additional measures to encourage more positive relations between the restaurant and its neighbors and will pursue the following:

1. Request DDOT stripe curbs adjacent to driveways in the blocks surrounding Listrani's to ensure neighbors can access their driveways at all times;

2. Request DDOT stripe parking spaces on Dana Place to ensure maximum parking for residents of the neighborhood -- Listrani's will be advised not to utilize Dana for parking but rather seek parking in areas that are not in Restricted Residential Parking (RRP) areas; and;

3. Organize two meetings a year (or as needed) at Listrani's between neighbors and the management.

The Chair of ANC 3D will take responsibility to work more closely with the restaurant and encourage neighbors to call on her if there is a consistent problem that needs to be brought to the attention of Listrani's management.

Each neighbor who signed the petition will be contacted and given the Chair's name. It is anticipated that by working regularly with the neighbors and the restaurant there will be better relations between parties and in the neighborhood.

The Commission asks the Alcoholic Beverage Regulation Administration to grant its 5-2-0 vote the great weight to which it is entitled under DC law and grant the DR license requested by Listrani's Restaurant.
