Advisory Neighborhood Commission 3D met at the Ernst Auditorium of Sibley Hospital on Wednesday, September 7th, 2005, at 7:30 pm. Present were Commissioners A. H. Gates, A. Haas, A. Heuer, H. Mullane, C. D. Ross, J. Stern and R. Thompson. Commissioner S. S. Shapley arrived later in the meeting. There were about 35 people in the audience. 1. POLICE REPORT – PSA 205 1.1. Lt. Sullivan presented the police report for PSA 205. 1.2. A graduate student, living on Hatfield Lane, was assaulted and robbed on his way home from the bus stop at about 11:30 PM. He was taken to Georgetown Hospital and treated for severe head injuries. 1.3. Seventeen crimes were reported, 88 tickets were issue mainly on Foxhall and on New Mexico Avenue.
2. The chair announced that she was just informed that morning that another Tour of Hope Bike Ride will take place on October 8, 2005. She noted there had been no complaints from the previous ride which was well publicized and coordinated by the Metropolitan Police. The purpose of the event is to raise funds and awareness for cancer research and clinical trials. She requested support from the Commission. ANC Action: Approve 7-0-0.
3. COMMUNITY CONCERNS 2.1 Andrea Ferster, lawyer for Neighbors for a Livable Community, presented their position opposing the use of Jacobs field at American University for intercollegiate games as being beyond the approved Campus Plan. Commissioner Shapley will draft a letter for the chair’s signature to Neil Stanley, deputy director of operations at DCRA, requesting DCRA take action and direct the university to refrain from use of the field for activities greater than allowed under the Campus Plan.

ANC ACTION: Approve 8-0-0 4. “LAWYERS HAVE HEART” RACE 4.1. Patty Burke spoke for the American Heart Association, sponsor of the Lawyers Have Heart Race, to request that a portion of their annual 10k race be permitted to run through Palisades.

Approve 7-0-0. 5. DRIVEWAY PERMIT FOR 5015 VAN NESS STREET 5.1. An application to occupy public space to construct a new driveway at 5015 Van Ness Street, NW, was presented by the homeowner, Matthew Goodman. 5.2. ANC ACTION: Approve 7-0-0.
6. DEVELOPMENT OF 1801 FOXHALL ROAD BY ST. PATRICK’S SCHOOL FRIENDS 6.1. Philip Fiola, zoning attorney for the Friends of St. Patrick’s School, presented a brief overview of a special exception request to subdivide the 17.3 acre property at 1801 Foxhall Road to construct a private school and build a theoretical lot subdivision. This estate was recently considered as the site for a Mayoral residence. 6.2. Architect Ankie Barnes presented slides and topographical diagrams of the site and explained the intent is to divide the property into three parcels which will include a new St. Patrick’s high school and middle school, an open space in the middle, and a development of 28 single-family houses, 9 of which can be built as a matter of right on parcels facing Hoban Road. A new intersection with expanded north lane will service traffic in and out of the school. An entrance to the housing development will be constructed at 45th and Hoban. The average proposed lot sizes will be 9,935 square feet, almost twice that required under R-1-B zoning. Lot occupancy and set back requirements will be met; and, public access to open space and the adjacent natural parkland will be preserved and enhanced. All residential homes will be required to comply with a set of architectural controls and guidelines, to enhance harmony and compatibility within the new development. Commissioners requested that particular attention be paid to the question of garage size and capacity, as the city rules are ambiguous. 6.3. Special consideration has been given to ensure maximum tree preservation. 6.4. Traffic stats and proposed lane configurations were presented briefly presented and a further traffic study to cover both the new school and the residential development will be presented later. 6.5. St. Patrick’s expects to make at least two more presentations to the ANC-3D and to present their application to the BZA in February 2006. The target for residential occupancy is 2009. 6.6. Terrence Staub, speaking for the Colony Hill Association, which borders the estate, stated that although there had been several meetings with the St. Patrick’s group, they are still opposed to the residential development. Their concerns embraced both traffic and environment.
7. PRESENTATION BY THE LAB SCHOOL OF WASHINGTON FOR A SPECIAL EXCEPTION TO INCREASE THE MAXIMUM STUDENT ENROLLMENT AND FACULTY/STAFF CAP; TO INSTALL ANGLED PARKING SPACES IN THE PUBLIC RIGHT-OF-WAY ALONG WHITEHAVEN PARKWAY; AND, TO PERMIT USE OF 4749 WHITEHAVEN PARKWAY FOR ADMINISTRATIVE OFFICES. 7.1. Allison Prince of Pillsbury, Winthrop, Shaw, Pittman law firm, and zoning attorney for The Lab School presented their plans to apply to the BZA for a Special Exception to increase the maximum student enrollment and faculty/student cap and to install angled parking spaces in the public right-of-way along Whitehaven Parkway. Mr. Kilsheimer, engineer and board member, also presented the options analysis for the problem of providing adequate parking spaces to meet the required number for the number of employees. 7.2. The submission will be presented later to the ANC-3D. The goal is to bring the school into line with its current BZA Order while requesting an increase in the faculty/staff and student population.

The commission expects to have a full presentation from their traffic
expert in October. 8. COMMISSION BUSINESS 8.1. The treasurer’s report for FY 05 was accepted. (See attachment.) 8.2. The proposed ANC budget for FY 06 was approved as presented by a vote of 8-0-0. An additional expense, not to exceed $500.00, was approved by a vote of 8-0-0 for purchase of a digital camera. 8.2.1. The budget, as amended, was accepted. (See attachment.) 8.2.2. Commissioner Stern will research how other commissions handle the reimbursement of commissioner’s expenses on behalf of the ANC. This may also be a matter for the DC Auditor. 8.3. The minutes of the July meeting were accepted. 8.4. Commissioner Jill Stern will participate on the Child Abuse Advisory Task Force, for which volunteer representation from across the city was solicited from ANCs and Wards. 8.5. A draft Mission Statement for the newly created ANC 3D Environment Committee was presented by Ann Haas. It was reviewed and accepted by a vote of 8-0-0. This committee will coordinate with the Zoning Committee when appropriate. (See attachment.) 8.6. The next meeting of ANC 3D will be Wednesday, October 5, 2005 to start at 7 pm.
