                                 MEETING MINUTES – October 3, 2007

The regularly scheduled monthly meeting of ANC3D was called to order by Chair Rachel Thompson at 7:04 PM.  Commissioners present: Thompson, Heuer, Haas, Gates and Smith.  Commissioner Wells arrived at 7:25 pm and Commissioner Sandza arrived at 8:20 PM.  There were 10 people in the audience.

There were no community concerns.

Lawyers Have Heart Race – will take place on June 14th, 2008.  Patty Burke made a brief presentation.  There have been no problems with this race in the past.  Commissioner Gates moved to support the race.  Commissioner Haas seconded the motion.  The motion passed 5-0-0.

Bistro Bernoise, 5120 MacArthur Boulevard – Herbert Kirshbaum is seeking a stipulated liquor license for the restaurant.  Mr. Kirshbaum has recently repurchased this restaurant and said he hopes to re-open it by November l, 2007. Everything has been updated.  The menu will remain the same, and the liquor license would allow them to attract more business before the slow winter months.  Their hearing is November 28th.  Commissioner Gates noted that they would be welcomed back into the neighborhood as their fare had been missed.  Commissioner Gates moved to approve the stipulated license, Commissioner Thompson seconded the motion and it was approved 5-0-0.

BZA 17680- Request for Special Exception extension for parking lot at 4817 U Street NW (CVS).  Carolyn Brown (Holland and Knight) and Tim Rederer (CVS) made a presentation requesting support for continued use of the adjacent parking lot at CVS.  The applicants outlined new conditions for use of the lot, including new ticketing and booting enforcement mechanisms.  Questions were raised about the parking controls and Commissioners raised concerns that the conditions and enforcement procedures could be unworkable and too punitive.  Commissioner Gates moved the application be tabled until the November meeting.  Commissioner Smith seconded the motion.  The motion was approved by a vote of 6-0-0.  Commissioner Wells arrived and participated in the discussion and vote.

BZA #17697 – 4818 Foxhall Crescents, NW.  Patrick Brown, attorney for the property owner/developer, once again asked for approval to construct a single family dwelling previously approved by the BZA in 1991.  Neighbors appeared before the Commission voicing their objections to this request. The two major issues concerning the neighbors in attendance were that conditions have changed since 1991, in particular storm water run off problems have caused flooded basements in the development, and that, because of the extinguishment of an easement, emergency vehicles can no longer turn around in the street in front of the subject property and its neighboring properties.  The neighbors in attendance indicated that other neighbors had objections to the application, but that they could not attend the meeting.

Commissioner Gates moved that this item be put on the November agenda, and Commissioner Heuer Seconded the Motion.  The Motion passed 7-0-0.  Neighbors were instructed by Commission Chair Thompson to submit their concerns about the application in writing to the Commission no later than October 24th so that the Commissioners have time to review their submission. Commissioner Sandza arrived and participated in the discussion and vote.

Commission Business

The minutes from the September meeting were approved -7-0-0

Treasurer’s report was given: There is currently a balance of $32,885.06 in the Bank of America checking account.

The budget for FY 2008 was presented for the second time - Commissioner Wells moved to accept and Commissioner Sandza seconded – the motion passed 7-0-0.

The next meeting will be November 7, 2007.
